Terms of Use
These Terms of Use (“Terms”), together with our Privacy Policy, govern your access to and use of the mobile applications and related services (the “Services”) published by Apptimize LLC (“we,” “us,” or “our”), including any applications we make available on the Apple App Store, Google Play Store, or other platforms.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install, access, or use the Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” and “your” will refer to that organization.
CHANGES TO THESE TERMS
We may modify these Terms at any time. Changes will be posted within the Services or otherwise communicated to you. By continuing to use the Services after changes are posted, you accept the modified Terms. We encourage you to review these Terms periodically.
ELIGIBILITY
You must be at least 13 years of age to use our Services. If you are under the age of majority in your jurisdiction, you must have the consent of your parent or legal guardian. By accessing or using the Services, you represent and warrant that you meet these eligibility requirements.
ACCOUNTS AND SECURITY
Certain features of the Services may require you to create an account or log in via a third-party service (e.g., Apple or Google). You are responsible for safeguarding your login credentials and agree not to share your account details with others. Notify us immediately of any unauthorized use of your account. You are responsible for all activity occurring under your account.
YOUR CONTENT
The Services may allow you to submit or upload text, images, or other materials (“User Content”). You retain all rights to your User Content.
By submitting User Content, you represent and warrant that:
You have all necessary rights and permissions to provide the User Content; and
The User Content does not violate any laws or infringe any third party's rights.
We do not claim ownership of your User Content. However, by submitting User Content, you grant Apptimize LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, create derivative works from, distribute, and display your User Content for the purpose of providing and improving the Services.
SUBSCRIPTIONS AND PAYMENTS
Some features of the Services may be available only through a paid subscription. Subscription fees, billing cycles, and payment methods are described in the platform marketplace listing (e.g., Apple App Store or Google Play Store).
By purchasing a subscription, you agree to the applicable fees and terms. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your store account settings.
Refunds are handled solely by Apple or Google according to their respective policies. We do not process refunds directly.
TRIAL PERIODS
We may offer trial periods for certain subscription plans. If you cancel before the trial ends, you will not be charged. If you do not cancel, the subscription will automatically convert to a paid subscription at the end of the trial period.
INTELLECTUAL PROPERTY RIGHTS
The Services and all related intellectual property — including text, images, graphics, logos, trademarks, user interface elements, design, and software — are owned by Apptimize LLC and/or its licensors.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Services without our prior written consent.
PROHIBITED USES
You agree not to:
Violate any applicable laws or regulations.
Interfere with or disrupt the operation or security of the Services.
Decompile, reverse engineer, or attempt to extract source code.
Send spam, unauthorized advertising, or solicitations.
Use the Services in any manner that infringes the rights of others or violates these Terms.
We may monitor use of the Services and may remove, restrict, or disable access to any content or User Content at our sole discretion.
TERMINATION
We may suspend or terminate your access to the Services at any time, without notice, if you violate these Terms or engage in conduct that may cause liability or harm to others. You may terminate your account at any time through the provided account tools or by contacting us.
Any obligations incurred before termination remain in effect.
DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR DO WE GUARANTEE THE ACCURACY, RELIABILITY, OR QUALITY OF ANY CONTENT.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPTIMIZE LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID TO US IN THE PAST SIX (6) MONTHS, OR
TWENTY DOLLARS (USD $20).
INDEMNIFICATION
You agree to indemnify and hold harmless Apptimize LLC, its affiliates, and their officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of France, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in the jurisdiction where Apptimize LLC is registered.
SEVERABILITY
If any part of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Apptimize LLC regarding the Services and supersede all prior agreements.
